Welcome to longfellowdesignbuild.com (the "Site"), operated by Longfellow Design Build ("Longfellow," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of the Site, including any content, functionality, and services offered through it. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
About Longfellow Design Build
Longfellow Design Build is a residential design-build firm offering architecture, interiors, construction, and engineering services across Greater Boston, the South and North Shores, Cape Cod, Lincoln NH, and Southwest Florida. The Site exists to share our work, our team, and our approach with prospective clients, candidates, and the public. Information on the Site is provided for general reference and does not constitute a contract, professional service agreement, or commitment to perform work.
Eligibility and Permitted Use
You must be at least 18 years old to submit information through the Site. You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit anyone else's use of the Site. Prohibited conduct includes attempting to gain unauthorized access to any portion of the Site, introducing malicious code, scraping or harvesting content for commercial purposes without permission, and using the Site to transmit unsolicited communications.
Intellectual Property
All content on the Site, including text, photography, video, illustrations, plans, renderings, layouts, the Longfellow Design Build name and logo, and the overall design and presentation, is owned by Longfellow or our licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may view and download Site content for personal, non-commercial reference only. Any other use, including reproduction, distribution, modification, public display, or use of any image of a built project, requires our prior written permission.
Photography of completed homes is published on the Site with the participation of the homeowners and our project partners. Requests for editorial or commercial use should be directed to our marketing team.
Submissions Through Forms
The Site offers a contact form and an employment application form. Information you submit is governed by our Privacy Policy. By submitting an inquiry, you do not create a client relationship with Longfellow; a client relationship is established only through a written agreement signed by both parties. By submitting an employment application, you acknowledge that submission alone does not constitute an offer or guarantee of employment, an internship, or a co-op placement.
If you provide a portfolio link, work sample, or other materials, you represent that you have the right to share them and that they do not infringe any third party's rights.
No Professional Advice
Content on the Site, including blog articles, project descriptions, FAQ entries, and service overviews, is provided for general educational and informational purposes. It is not a substitute for project-specific architectural, engineering, legal, financial, or regulatory advice. Building codes, zoning ordinances, permitting requirements, and pricing vary by jurisdiction and site, and the figures and timelines published on the Site are general references, not project quotes. Any reliance you place on Site content is at your own risk.
Projects, Pricing, and Availability
Project photography, descriptions, awards, and press coverage reflect work completed at a point in time. Materials, finishes, and design details shown in past projects may not be available, advisable, or replicable on your site. Published pricing ranges and timelines are starting references that depend on scope, site conditions, market conditions, and selections. Final pricing and schedule are established in your project agreement.
Third-Party Links and Affiliates
The Site links to third-party websites and platforms, including social media accounts and the websites of our affiliates and partners (such as Vineyard Home, Clarendon Interiors, and South Peak Resort). We provide these links for convenience. We do not control and are not responsible for the content, policies, or practices of third-party sites. Your use of those sites is governed by their own terms and policies.
Disclaimer of Warranties
The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Longfellow disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy or completeness of content. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected.
Limitation of Liability
To the fullest extent permitted by law, Longfellow, its parent company Waterside Group, and their respective officers, directors, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or in connection with your access to or use of the Site. Our aggregate liability for any claim arising from the Site will not exceed one hundred dollars ($100). Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
Indemnification
You agree to indemnify and hold harmless Longfellow and its affiliates from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any law or third-party right.
Changes to the Site and These Terms
We may update, modify, suspend, or discontinue any portion of the Site at any time without notice. We may also revise these Terms from time to time. The Effective Date above indicates when the current version took effect. Continued use of the Site after a change constitutes acceptance of the updated Terms.
Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Suffolk County, Massachusetts, and you consent to the personal jurisdiction of those courts.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
